JetBlue’s “All You Can Jet” Sweepstakes

OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. BY SUBMITTING AN ENTRY, YOUR ENTRY MATERIALS, AS DEFINED BELOW, MAY BE INCLUDED IN SPONSOR’S COMMERCIAL MATERIAL, AS WELL AS AT SPONSOR’S WEBSITE OR SOCIAL MEDIA PLATFORMS.

1. Sweepstakes Period: These Official Rules apply to the “All You Can Jet” Sweepstakes (“Sweepstakes”). The Sweepstakes begins on February 27, 2019 at 12:00:01 am Eastern Time (“EST”) and ends on March 8, 2019 at 8:59:59am EST (“Sweepstakes Period”).

2. Sponsor: JetBlue Airways Corporation, located at 27-01 Queens Plaza North, Long Island City, New York 11101 (hereafter, “Sponsor”, “JetBlue Airways” or “JetBlue”).

3. Eligibility: This Sweepstakes is only open to legal residents of the fifty (50) United States, including the District of Columbia, and Puerto Rico, 18 years of age or older at the time of entry. Void outside the 50 United States, the District of Columbia, Puerto Rico, and where prohibited. Employees, officers and directors of JetBlue Airways Corporation (“JetBlue” or “Sponsor”); Promosis, Inc. (“Administrator”) and each of their respective parent companies, affiliates, distributors, subsidiaries, prize providers, advertising/promotion agencies and the immediate family members (spouses, parents, children and siblings and their respective spouses, regardless of where they reside) and/or those living in the same household of any of the foregoing, whether or not related, are not eligible to enter or win. Sponsor, Administrator, Instagram, Inc., and each of their respective parent companies, affiliates, distributors, subsidiaries, prize providers, and advertising/promotion agencies are each a “Released Party” and shall hereinafter collectively be referred to as the “Released Parties.”

4. To Enter: Entrants are required to have an Instagram account, available for free sign up at https://www.instagram.com/. To enter, visit www.jetblue.com/aycj any time during the Sweepstakes Period and upload to the site a photo image taken by you. Using the customization tool on the site, customize the image by completing the “All You Can _________” caption and download the image. Then, delete or archive all your Instagram images and upload the customized promotion image to Instagram, tagged with #AllYouCanJetSweepstakes and with the mention @jetblue. Entries must be submitted and received by 8:59:59am EST on March 8, 2019; entrants must keep their Instagram feeds clear through 11:59:59pm EST on March 8, 2019. Limit one (1) entry per person. If you do not have an Instagram account, establishing an account is free. All Instagram terms apply. Your Instagram account must be set to “public” in order for your Entry to be eligible. You can return the account to “private” any time after the winners have been announced. Entering multiple entries will result in Sweepstakes disqualification. Entries generated by script, macro, or other automated means will be void. Entries must be the entrant’s own original work, and must not include or depict any brand other than Sponsor’s or any content that may be deemed obscene, sexual, violent, or offensive. Entries must not defame, misrepresent or contain disparaging remarks about Sponsor, its products or services, or other people or companies, or violate the privacy or publicity of any person, or infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property, or other legal or moral rights of any person or entity. Any submitted entry containing inappropriate content of any kind will be disqualified, at Administrator’s sole discretion. Sponsor reserves the right to publish any submitted entries, in full or in part, in any and all media. Publication of an entry is not intended to indicate that the entry has been selected as a prize winner or is favored in any way. All entries become the property of the Sponsor and will not be acknowledged or returned. By submitting an entry, entrant agrees to abide by the terms of these Official Rules, the decisions of the Sponsor and Administrator, and the Sponsor’s Privacy Policy available at https://www.jetblue.com/legal/privacy. Sweepstakes is subject to all federal, state, local laws and regulations.

5. Trademarks: All trademarks and trade names featured at jetblue.com and at Sponsor’s social media platforms are trademarks of Sponsor ("Sponsor's Trademarks").

6. Drawings and Winner Notification: Potential Grand Prize winners will be selected via a random drawing from among all eligible entries received. Drawing will be conducted after the conclusion of the Sweepstakes Period on March 8, 2019 by Administrator, an independent judging organization whose decisions will be final and binding in all matters relating to this Sweepstakes. Potential Grand Prize winners will be notified on or about March 11, 2019 by Administrator, via Instagram direct message, to obtain contact information for follow-up eligibility verification via email from Promosis. Potential Grand Prize winners must respond within one (1) day of the initial direct message notification. After responding to the initial notification, potential Grand Prize winners will be required to complete and have notarized an Affidavit of Eligibility and liability/right of publicity release (except where prohibited) that must be returned within three (3) days of the date of the email notification, or prize may be forfeited. Any entry or entrant that is determined to be ineligible according to eligibility requirements, or any prize notification that is returned as undeliverable, or any potential Grand Prize winner who does not respond to the winner notifications or refuses to accept the prize will be disqualified, and an alternate Grand Prize winner may be randomly selected from the remaining pool of participants received for the original drawing. A selected potential Grand Prize winner will not be an official Grand Prize winner until all required documentation has been returned, and eligibility has been formally verified. Sponsor is not responsible for fraudulent calls or emails made to entrants or Grand Prize winners not by Sponsor or Sweepstakes Administrator. Each Grand Prize winner will be required to provide Administrator his/her Social Security number for tax purposes. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for any recipient who receives a prize if the annual aggregate value of the prize received is $600 or more. Administrator will issue a Form 1099-MISC to prize winners for value of prize received. Odds of winning will depend upon number of eligible entries received.

7. Prizes: Three (3) Grand Prizes: Each Grand Prize consists of one (1) JetBlue All You Can Jet Pass valid for unlimited air travel (subject to availability) for one (1) year for winner and one (1) Travel Companion per flight on any JetBlue-operated flights, in accordance with the terms and conditions set forth below. The approximate retail value of each Grand Prize = $20,000. The total approximate retail value of all prizes = $60,000. No substitution or transfer for prize permitted. Prizes cannot be redeemed for cash, transferred, or substituted by Grand Prize winners; however, Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Limit one (1) prize per person. No more than the stated number of prizes will be awarded. All prize details are at Sponsor’s sole discretion.

8. All You Can Jet Pass Terms and Conditions: The JetBlue All You Can Jet Pass (“Pass”) includes unlimited travel on JetBlue-operated flights for one person (“Pass Holder” or “you”) and one (1) Travel Companion per flight who must accompany Pass Holder on the same itinerary, subject to the following terms and conditions: Booking: Eligible travel can only be booked and managed on the Pass by the Pass Holder for a period of one (1) year, between 4/1/2019 – 3/31/2020. Travel using a Pass must be booked by calling 1 (800) JETBLUE or by TTY/TDD telephone number, 1-800-336-5530, choosing option 2 and booking through the TrueBlue desk and cannot be booked online or any other way. Pass may be used for new bookings only and may not be applied to any existing reservations prior to the distribution of the Pass. Booking multiple flights departing from the same city on the same day is prohibited; any such bookings will be canceled immediately with the exception of the most recently booked flight. Only the Pass Holder may book travel using the Pass. You must be a TrueBlue member to use the Pass. If you are not a TrueBlue member, joining is free by registering at https://trueblue.jetblue.com/. Travel: Pass may be used for travel on JetBlue-operated flights with scheduled departure times between 12:01 am local time on 4/1/2019 and 11:59pm local time on 3/31/2020. All travel using a Pass is subject to availability; all seats on eligible flights are available for booking by the public and are subject to selling out. A PASS DOES NOT GUARANTEE AVAILABILITY ON ANY PARTICULAR FLIGHT. Flight schedules are subject to change without notice or liability to you. Pass is for eligible travel on JetBlue-operated flights, only, and is not valid for use on Mint seats, Even More Space seats, in connection with partner or codeshare or interline flights, JetBlue Vacations packages, cruises, gift cards, merchandise, hotel rooms, rental cars, or any other products or services. Taxes: Pass Holder is responsible for all taxes and fees that apply to any flights booked using the Pass, which must be paid with a valid credit card at the time of booking. Pass does not cover fees for products or services sold separately, including, but not limited to any applicable baggage fees including those for oversized, overweight or extra baggage, drinks, meals, fees for products/services sold separately, such as unaccompanied minor fees, pet fees, etc. To view baggage fees and other optional services and fees, see http://www.jetblue.com/legal/fees/. NO-SHOW PENALTY/CHANGES/CANCELLATIONS FEES: IF YOU BOOK TRAVEL USING YOUR PASS AND (i) DO NOT CHECK-IN AND BOARD YOUR FLIGHT PRIOR TO SCHEDULED DEPARTURE; (ii) REQUEST ANY CHANGES OR CANCELLATION TO ITINERARY WITHIN 24-HOURS TO SCHEDULED DEPARTURE, A “NO-SHOW/CHANGE/CANCELLATION” PENALTY OF $150 PER TRAVELER ON THE RESERVATION IS INCURRED AND PASS WILL BE SUSPENDED (NO BOOKING AND NO TRAVEL) UNTIL YOUR PENALTY IS PAID BY CALLING 1 (800) JETBLUE (1-800-538-2583), option 2. No additional time will be added to a Pass that has been suspended. Pass will be forfeited after three (3) "no shows." Changes or cancellations to a scheduled booking or Travel Companion made at least 24 hours before scheduled departure to bookings made using your Pass will not be subject to any fee. Changes to the name of a Travel Companion within 24 hours of scheduled departure may only be made by calling the TrueBlue desk at least 1 hour prior to scheduled departure and paying a fee of $150 per name change. Non-Transferability: Pass is non-transferable and may not be purchased, sold, bartered, or otherwise exchanged for value. Any attempt to transfer a Pass or book travel on Pass for someone other than you accompanied by your Travel Companion may, in JetBlue’s sole discretion, result in immediate forfeiture of your Pass. TrueBlue: Use of the Pass will not earn any TrueBlue points. Flights flown using Pass will not count toward TrueBlue Mosaic or any TrueBlue offers or bonuses. Use of Pass will not earn any BlueCities Badging Points. Additional Restrictions: Pass cannot be combined with any other offers and has no cash value and is not redeemable for cash. Travel booked and flown using Pass is subject to and entitled to all provisions of JetBlue’s Contract of Carriage (see JetBlue’s Contract of Carriage at http://www.jetblue.com/p/jetblue_coc.pdf for details). In the event of any conflict between any terms and conditions and these All You Can Jet Pass Terms and Conditions, these All You Can Jet Pass Terms and Conditions will apply. ANY VIOLATION OR ATTEMPT TO VIOLATE THESE TERMS OR ANY REASONABLE SUSPICION OF ENGAGEMENT IN ANY ILLEGAL BEHAVIOUR, IN JETBLUE’S SOLE DISCRETION, MAY RESULT IN YOUR FLIGHT RESERVATION BEING CANCELED AND/OR FORFEITURE OF YOUR PASS. Any public statements disparaging, inaccurate or reflecting negatively on JetBlue or its’ brand may also result in cancellation of your pass.

9. Specific Prize Restrictions: Grand Prize winners are responsible for all applicable federal, state, international and local taxes (if any), trip insurance, any and all expenses and incidental travel costs not expressly stated in the Grand Prize description herein, including but not limited to any and all ground transportation to/from a Grand Prize Winner’s residence and gateway airport serviced by JetBlue closest to the Prize Winner’s residence, travel upgrades, baggage fees, surcharges, personal incidentals, and any other expenses not specified as a part of a prize stated herein. JetBlue is not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Certain other JetBlue restrictions and blackout dates may apply, which may include a Saturday night stay, all of which are subject to change at the sole discretion of Sponsor. Grand Prize Winners may change their Travel Companions on a per trip basis; Travel Companion is not required to be the same for all bookings. No substitutions or deviations with respect to origin or destination(s) will be allowed. Each Grand Prize Winner and his or her Travel Companion must depart on same travel itinerary and return on same travel itinerary and will be responsible for all necessary travel authorizations and travel insurance, if any. In the event that travel involves a connection through a JetBlue gateway city and connecting flights are not available on the same date of travel, Grand Prize Winner(s) will be provided with lodging and ground transfers to/from airport in gateway city at sole discretion of Sponsor. If a Travel Companion is deemed a minor under the jurisdiction of his/her state of residence, that Travel Companion must be accompanied by a parent or legal guardian. Travel Companion (or their parents or legal guardians) will be required to execute and return a travel/liability release and (where legal) publicity release prior to issuance of travel documents. No additional travel expenses or any other aspects of any prize will be awarded should Travel Companion’s parent or legal guardian be required to accompany Travel Companion. Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage, or any natural disaster outside their control that may cause the cancellation or postponement of prize events. Winners and Travel Companions must possess required travel identification documents, e.g. photo identification, passport, or visa, and are solely responsible for obtaining any necessary documentation and fulfilling any necessary travel requirements prior to travel. JetBlue reserves the right to deny boarding to passengers without the proper documentation. The Booking and Travel dates referred to above for the Pass will not be extended in any event. All travel is subject to any and all restrictions instituted by the Department of Defense and/or Department of Homeland Security, as required. Other restrictions apply.

10. General Conditions: Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, prizes will be awarded via random drawing from among all non-suspect, eligible entries received up to the time of such cancellation or in another manner otherwise deemed fair and appropriate by Sponsor.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE SWEEPSTAKES OR TO UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Waiver of Liability and Release: By participating in the Sweepstakes and submitting an entry, each entrant waives, discharges, and fully releases Released Parties from any and all liability, injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the Sweepstakes or from the receipt or use of any prize or from any activity related to the receipt or use of any prize. By receipt of any prize, each Grand Prize Winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to, or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize and assumes the risk(s) of traveling to a city other than his/her own.

12. Publicity Grant and License/Use of Entries: By submitting an entry, each entrant waives all moral rights in and to the entry and grants to Sponsor and its licensees, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the entry and all elements of such entry, together with any other material, and the name, user name, city and state of residence, voice, image and/or likeness of entrant (including, but not limited to, profile photo), in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, entrant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade. Entrant agrees that, if required by Sponsor, he/she sign documents to this effect. Released Parties are not responsible for any unauthorized use of Entries by third parties. Sponsor has no obligation to make use of the rights granted herein.

13. Limitation of Liability: Released Parties are not responsible for stolen, late, incomplete, inaccurate, misdirected, lost, damaged, garbled, delayed, or incomplete entries or email; for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections; availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, or lines; or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing, or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participant‘s or any other person's computer, wireless phone/smartphone or landline phone related to or resulting from participating in this Sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten, or harass any other entrant or any representative of Sponsor and/or the Released Parties, or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, and their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes and to resolve all disputes in its sole discretion. Instagram, Inc. is not a sponsor of this Sweepstakes, nor are they responsible for the award of any prize.

14. Dispute Resolution: By entering the Sweepstakes, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or the prize awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, and in no event will entrant be entitled to receive attorneys' fees or other legal costs; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of New York, County of New York, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

15. Use of Information: The information that an entrant provides in connection with the Sweepstakes may be used by Sponsor in accordance with its Privacy Policy, which is found at http://www.jetblue.com/about/privacy.html and which may be updated from time to time without notice.

16. Winners List: For the names of the Grand Prize winners, available until June 8, 2019, send a standard-size postcard, only, with your name and address to: JetBlue’s “All You Can Jet” Sweepstakes, P.O. Box 38, Marblehead, MA 01945. Do not send any other correspondence to this address.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

The Sweepstakes is not sponsored, endorsed or administered by Instagram.

17. NATURE OF SPONSOR’S BUSINESS: Air Transportation.
